This Privacy Policy is intended for our customers, suppliers, partners, website visitors, and other persons with whom we interact. We are committed to complying with all requirements and obligations relating to the processing of personal data under the General Data Protection Regulation (“GDPR”)

We recognize that information privacy is an ongoing responsibility, so we will from time to time update this Privacy Policy as we undertake new personal data practices or adopt new policies. This privacy policy does not apply to the applications, websites or services offered by our Customers. This privacy policy also does not apply to the personal data or information of the users, (prospective) customers or partners of our Customers

2. Collection and processing of personal data

2.1. (Potential) customers, suppliers, and other partnersDatasmash collects personal information about its (potential) customers, suppliers, and other partners. With a few exceptions, this information is generally limited to:

- name
- job
- title
- employer
- namework
- address
- work email
- work phone number

We use this information to provide prospects and customers with services. We do not sell personal information to anyone and only share it with third parties who are facilitating the delivery of our services. In certain specific cases, e.g. in the context of disputes, including where disclosure is necessary for the establishment, enforcement, or defence of Datasmash’s legal claims, Datasmash may disclose personal data to advisors or other relevant third parties, if deemed lawful and necessary.

2.2. Website visitors

As is true of most other websites, Datasmash’s website collects certain information automatically and stores it in log files. The information may include internet protocol (IP) addresses, the region or general location where your computer or device is accessing the internet, browser type, operating system and other usage information about the use of Datasmashs’s website, including a history of the pages you view. We use this information to help us design our site to better suit our users’ needs. We may also use your IP address to help diagnose problems with our server and to administer our website, analyse trends, track visitor movements, and gather broad demographic information that assists us in identifying visitor preferences. Datasmash has a legitimate interest in understanding how members, customers and potential customers use its website. This assists Datasmash with providing more relevant products and services, with communicating value to our sponsors and corporate members, and with providing appropriate staffing to meet member and customer needs. Additionally, your personal data will be processed by certain third parties, among them the provider of the technical solution behind our website and analytics tools, on Datasmash’s behalf and in accordance with Datasmash’s instructions. These data processors may not process your personal data for their own purposes. 

3. Data storage, transfer and disclosure

Your personal data is stored and processed in the European Union. We only transfer data within jurisdictions subject to data protection laws that reflect our commitment to protecting the privacy of our users. Datasmash retains service data for the duration of the customer’s business relationship with Datasmash and for a period of time thereafter, to analyse the data for Datasmash’s own operations, and for historical and archiving purposes associated with Datasmash’s services. Datasmash retains prospect data until such time as it no longer has business value. All personal data that Datasmash controls may be deleted upon verified request from subjects or their authorised agents. 3.2. Third parties

Datasmash works with certain third parties to provide specific functionalities. These access data solely for the purpose of performing specific tasks on behalf of Datasmash and do not have permission to disclose or use any data for any other purpose.

Google Cloud Platform: Cloud storage provider
Google Workspace: E-mail, docs and calendar for Datasmash employees
Hubspot: CRM system
Slack: Internal communication and customer support

We do not otherwise reveal your personal data to non-COMPANY persons or businesses for their independent use unless: (1) you request or authorise it; (2) the information is provided to comply with the law (for example, compelled by law enforcement to comply with a search warrant, subpoena, or court order), enforce an agreement we have with you, or to protect our rights, property or safety, or the rights, property or safety of our employees or others; (3) the information is provided to our agents, vendors or service providers who perform functions on our behalf; (4) to address emergencies or acts of God; or (5) to address disputes, claims, or to persons demonstrating legal authority to act on your behalf. We may also gather aggregated data about our services and website visitors and disclose the results of such aggregated (but not personally identifiable) information to our partners, service providers, advertisers, and/or other third parties for marketing or promotional purposes.
